Asst. city manager arrested, charged in domestic violence dispute
Famularo now suspended from work without pay
Asbury Park’s assistant city manager James Famularo was arrested on Sunday and charged with assault, police chief Mark Kinmon said.
The police responded to a domestic violence 9-1-1 call at his home shortly after 3 a.m., Kinmon said. The officers ultimately charged Famularo with simple assault under the domestic violence statute, as well as one count of aggravated assault on a police officer and one count of resisting arrest.
The domestic violence statute effectively takes discretion out of the arresting officer’s hands, Kinmon said.
“The domestic violence guidelines cover certain crimes against a spouse or a live-in boyfriend or girlfriend, or a co-parent,” Kinmon said. “It’s out of the police’s hands and calls for a mandatory arrest … We had enough probable cause and evidence to believe the offense occurred, which triggers a mandatory arrest.”
Famularo is currently suspended from his job as assistant city manager without pay, Kinmon said.
His bail was set at $2,500 for the simple assault charge and $7,500 for the aggravated assault and resisting arrest. He posted bail late Sunday morning, the chief said. The investigation is still active.
Famularo was a member and president of the Asbury Park board of education in the 1990s.
