Ocean Grove gallery owner pleads guilty to child pornography
Prosecutor recommends conditional probation
A former Ocean Grove business owner and resident has pleaded guilty to possessing child pornography, Acting Monmouth County Prosecutor Christopher J. Gramiccioni announced Tuesday.
Peter Tumblety, 58, now living in the Port Monmouth section of Middletown, was charged with third degree endangering the welfare of a child for the possession of child pornography, according to a news release from the Prosecutor’s Office.
He admitted Monday before Monmouth County Superior Court Judge Joseph W. Oxley to being in possession of less than 100 images depicting the sexual exploitation or abuse of child, Prosecutor’s Office spokesman Charles Webster said.
When he was arrested on March 19, Tumblety owned a local art gallery and was residing on Pilgrim Pathway.
Members of the Monmouth County Prosecutor’s Office Computer Crimes Unit made the arrest based on a CyberTip from the National Center for Missing and Exploited Children [NCMEC], Webster said. The CyberTip indicated Tumblety uploaded images of child pornography to a Microsoft SkyDrive account.
Tumblety is scheduled to be sentenced on May 20
Per a plea agreement, the Prosecutor’s Office will recommend Tumblety be sentenced to probation with conditions, including a psychiatric evaluation, no unsupervised contact with children under the age of 18, restricted internet use, and random monitoring of his computer and other internet devices by law enforcement or probation officers.
The case is assigned to Monmouth County Assistant Prosecutor Margaret Koping and Tumblety is represented by Brian Ansell, Esq., of Ocean Township.
