The Asbury Addresses Noise Complaints
Sound Mitigation Conditions Placed on Liquor License Renewal
Four special conditions were placed on The Asbury’s liquor license renewal Wednesday before the Asbury Park City Council’s unanimous vote of approval. The conditions address noise complaints from area residents.
City attorney Frederick Raffetto said city officials, including himself, City Manager Michael Capabianco and Deputy Police Chief David Kelso, met with the hotel’s management.
The conditions, as outlined by Raffetto, include:
The installation of a decibel reader at the DJ booths at Salvation and the pool so that entertainers and/or staff members can monitor the music levels in a good faith effort to comply with the city’s noise ordinance guidelines. Additional readers will be installed at all outdoor location where music is played.
The Asbury will work with the Asbury Park Police Department with regard to the education of decibel level management and noise reduction. The Asbury agrees to meet with police department as deemed necessary by the governing agency.
The Asbury will implement a sound mitigation program – a June 29 remedial measure plan by Robert A Hanson Associates, which includes the removal of certain speakers and the installation of smaller overhead downward facing speakers at the outdoor rooftop Salvation bar. An installation schedule must be provided to the city manager and police department with periodic updates of the installation schedule until remedial measures have been completely installed.
And while The Asbury met with the Esplanade Homeowners Association, if deemed necessary by the police department and communicated in writing, The Asbury must hold additional meetings with the Esplanade or any other resident within 200 feet to discuss the sound mitigation.
The conditions will be enforced by the Asbury Park Police Department.
“We did meet with the hotel and thank you very much for coming and thank you very much to the Council for hearing all our concerns and addressing them,” Esplanade resident Randi Moore said during the public comment period prior to the vote. “It has been a lot better this summer.”
