Neptune man charged with St. Pat’s Day shooting
19-year-old Asbury Park man suffered one gunshot wound in incident
A Neptune Township man was arrested and charged in connection with the March 17 shooting of 19-year-old Asbury Park resident Sean O’Rourke, according to a news release from the Monmouth County Prosecutor’s Office.
Omar Jackson, 21, of the 200 block of Myrtle Ave., faces charges of attempted murder, possession of a weapon for an unlawful purpose, and unlawful possession of a weapon in connection with the incident.
Neptune Township Police Department responded to two 9-1-1 calls around 8:03 p.m. on Monday, March 17, 2014 reporting shots fired in the 300 block of Myrtle Avenue in the township. Police found O’Rourke suffering from a single gunshot wound when they arrived on the scene. He was transported to Jersey Shore University Medical Center where he received treatment for life-threatening injuries, the release stated.
A joint investigation by the Monmouth County Prosecutor’s Office and Neptune police determined Jackson fired the gunshot that struck O’Rourke.
If convicted, of the murder charge, Jackson faces a maximum potential custodial sentence is a state prison term of up to 20 years under the terms of the No Early Release Act (NERA), which would require him to serve 85 percent of the his sentence before he is eligible for parole, the release states.
If convicted of either weapons charge, the maximum sentence is 10 years in a state prison pursuant to the provisions of the “Graves Act,” which requires a mandatory period of parole ineligibility amounting to one half of the sentence imposed, or 42 months, whichever is greater, the release states.
Despite these charges, every defendant is presumed innocent, unless and until found guilty beyond a reasonable doubt, following a trial at which the defendant has all of the trial rights guaranteed by the U.S. Constitution and State law.
The case is assigned to Monmouth County Assistant Prosecutor Matthew Bogner.
Investigators from the Monmouth County Prosecutor’s Office, Neptune Township Police Department and Asbury Park Police Department made the arrest.
